TRANSACTION - the collection or refund of an amount resulting from the sale of a product by ESOTERIC MASSAGE ACADEMY to the Client, using the services of the card processor approved by ESOTERIC MASSAGE ACADEMY, regardless of the delivery method.

Transactions can only take place within the territory of Romania. Deliveries to addresses in other countries are not accepted for Orders placed using the esotericmassageacademy.com platform.

1.1. The design and presentation of the website, as well as its settings, menus, submenus, and functionalities, are the property of ESOTERIC MASSAGE ACADEMY.

1.2. The website, trademarks, logos, slogans, texts, images, databases, as well as all other materials and elements that are part of the website, are the property of ESOTERIC MASSAGE ACADEMY or its partners and are subject to intellectual property rights, in accordance with applicable Romanian and international law.

1.3. Reproduction, distribution, or publication, in any form, of the content of the website and the elements presented on this website by any person without the prior written consent of ESOTERIC MASSAGE ACADEMY is prohibited.

1.4. Any attempt, of any nature, to modify the images of ESOTERIC MASSAGE ACADEMY, as well as the creation of links with unfounded messages that refer to pages on the website, gives ESOTERIC MASSAGE ACADEMY or any other legal beneficiary of the intellectual property rights mentioned above the unilateral and unequivocal right to use all its prerogatives to address the competent legal authorities to sanction these acts. 2.1. The website can be accessed for free. ESOTERIC MASSAGE ACADEMY does not guarantee that the website will be accessible at all times, without interruptions. ESOTERIC MASSAGE ACADEMY may suspend, withdraw, terminate, or modify the website in whole or in part without prior notice.

2.2. ESOTERIC MASSAGE ACADEMY will not be liable in the event that the website cannot be accessed, regardless of the reason for the inability to access and regardless of the duration of this inability.

2.3. The User is responsible for taking all necessary actions to access the website. Additionally, the User is responsible for ensuring that all persons who access the website through the internet network made available by the User are aware of and implement these Terms and Conditions of use, as well as any other applicable conditions.

2.4. Any person who wants details about the services or products presented on the website is asked to contact ESOTERIC MASSAGE ACADEMY representatives to find out about the availability of the service or product in question, as well as the contractual conditions. ESOTERIC MASSAGE ACADEMY reserves the right to restrict access to the products and services described on this website to certain persons or in certain areas/countries. None of the products or services presented on the website will be provided to a person by ESOTERIC MASSAGE ACADEMY if Romanian legislation prohibits this.

3. Online Sales Policy

3.1. Users who own or create an account on the website have the option to pay for orders through the website.

3.2. Sharing an account between multiple Users is prohibited. In case such actions are discovered, ESOTERIC MASSAGE ACADEMY reserves the right to cancel or suspend Users' access to the website or to suspend/close the account.

3.3. ESOTERIC MASSAGE ACADEMY may publish information on the website about products and/or promotions offered by it or by third parties with which ESOTERIC MASSAGE ACADEMY has partnership contracts, for a certain period and within the limits of available stock.

3.4. Products purchased through the website are intended exclusively for the personal use of the Client.

3.5. ESOTERIC MASSAGE ACADEMY may limit the purchase capacity of some products or courses available on the website at a given time, for one or more Clients.

3.6. All fees related to the products or services presented on the website are expressed in Romanian Lei (RON) and include VAT.

3.7. The prices displayed on the website with a strikethrough line signify the initial sale price, before the discount.

3.8. The billing of purchased products is done exclusively in Romanian Lei (RON).

3.9. The accepted payment methods are as follows:

  • online with a bank card,
  • by bank transfer

3.10. In the case of online payments, ESOTERIC MASSAGE ACADEMY is not/cannot be held responsible for any additional costs incurred by the Client, including but not limited to currency conversion fees applied by the card-issuing bank if its currency differs from RON. The responsibility for this action lies solely with the Client.

3.11. In the product and/or course descriptions, ESOTERIC MASSAGE ACADEMY reserves the right to use other products (such as accessories) that may not be included in the costs of the respective products. The images are displayed for presentation purposes on the website, and the products actually delivered may differ from the images shown in any way (color, accessories, appearance, etc.), due to external factors such as the light used.

3.12. ESOTERIC MASSAGE ACADEMY reserves the right to modify the prices for the products available on the website before the Client places the Order, without prior notice to the Client.

3.13. The purchase price of the products is the one at the time of placing the Order, within the limits of available stock.

3.14. The purchase price of promotional products is the one at the time of placing the Order, within the limits of available stock and/or the promotional period, if defined.

3.15. The purchase price of the products in an Order issued cannot be modified at a later time without the agreement of the parties.

3.16. By completing the Order, the Client consents that ESOTERIC MASSAGE ACADEMY may contact them, for the following purposes/situations, by any means available/agreed by ESOTERIC MASSAGE ACADEMY depending on the purpose/situation:

  • Non-acceptance by the card-issuing bank of the Client's card transaction, in the case of payment by bank card;
  • Cancellation of the transaction by the card processor approved by ESOTERIC MASSAGE ACADEMY, in the case of payment by bank card.
  • For the mandatory validation of the availability of the products and the quantities purchased by the Client within 48 hours of placing the Order.
  • Client's validation of the Order value, including, depending on the situation, other value-added services (e.g., transport, etc.)
  • Agreement on the delivery details of the products.

3.17. ESOTERIC MASSAGE ACADEMY may automatically cancel the Order made by the Client without any further obligation of either party or without any party being able to claim damages in the following cases:

  • Non-acceptance by the card-issuing bank of the Client's card transaction, in the case of online payments;
  • Cancellation of the transaction by the card processor approved by ESOTERIC MASSAGE ACADEMY, in the case of online payments;
  • The data provided by the Client on the website is incomplete or incorrect;
  • The Client's activity on the site may cause damages of any kind to ESOTERIC MASSAGE ACADEMY and/or its partners.

3.17.1. If the Client has chosen to pay by card when placing the Order, after the Order is validated, the Client is required to enter the necessary data for payment processing.

3.18. The steps to complete an Order are as follows:

a. The Client selects the products and adds them to the shopping cart; b. When the Client decides to place the Order, they select the buy option; c. After selecting the payment method, the Client is required to enter the requested data, in the case of payment by card, additional data will be requested for payment processing. d. The Order is processed, and the delivery will be made.

3.18.1. If the client has chosen to pay by bank card and the value of the purchased products has been blocked on their card, they have the right to modify the content of their Order when contacted by ESOTERIC MASSAGE ACADEMY, within the value blocked on their card.

3.18.2. If, upon confirming the Order, the Client finds that certain products Ordered by them are not available, they have the right to cancel the Order, process the Order without the missing products, or add other products to the Order. If the Client modifies the initial Order, it is considered a new Order and is subject to the steps outlined above.

3.18.3. Once the Client validates the value of the Order placed, or if ESOTERIC MASSAGE ACADEMY informs the Client of their validated Order, the Order becomes a Distance Contract, in accordance with Emergency Ordinance no. 34/2014 on the rights of consumers in contracts concluded with professionals, as well as for the amendment and completion of some normative acts.

3.18.4. If the placed Order contains online courses, as soon as the payment is made, the Client will receive an email with access to the purchased course within a maximum of 24 working hours.

3.19. Shipping

3.19.1. ESOTERIC MASSAGE ACADEMY will include in the package sent to the Client all necessary documents to attest to the purchase of the products by the Client.

3.19.2. ESOTERIC MASSAGE ACADEMY will facilitate informing the Client about the status of the Order or contract completion.

3.19.3. The Client has the following transport method available: courier service (Fan Courier).

3.19.4. The delivery fee is 25 RON. The delivery cost will be displayed on the checkout page.

ATTENTION! Product delivery to the Client is only done to an adult based on an identity document!

3.19.5. Deliveries will be made within 5 days of confirming the Order, without exceeding the 30-day period. If the product cannot be delivered, ESOTERIC MASSAGE ACADEMY undertakes to inform the Client about this unavailability, and the amounts paid by the Client as payment will be refunded by ESOTERIC MASSAGE ACADEMY within a maximum of 30 days.

3.20. Quality and Guarantees

3.20.1. Certain products may benefit from a contractual warranty, and this will be mentioned in the product sheet at the time of exclusive sale on the esotericmassageacademy.com website. Clear details regarding these warranties are provided by the product sheets, and no Client can request an extended warranty beyond what is mentioned. This means that the warranty of the products offered by ESOTERIC MASSAGE ACADEMY is the one offered by the suppliers of ESOTERIC MASSAGE ACADEMY.

3.20.2. ESOTERIC MASSAGE ACADEMY does not guarantee the stock availability of any product available for purchase on the site.

3.20.3. Access to the recorded course materials

Access to the video materials and course recordings available on our platform is provided exclusively to active participants, during the course's duration for which they signed up. In case a participant decides to withdraw from the course after completing one or more modules, access to the materials related to the entire course will end at the time of withdrawal. Only participants who complete the entire course will have access to recordings until the official end date of the respective course. After this date, access will be automatically suspended.

3.21. Product Returns and Contract Withdrawal

3.21.1. Any ESOTERIC MASSAGE ACADEMY Client can return purchased products through the website in the following situations:

  • The products you return are in the same condition as you received them. Make sure the product has the original tags intact, the warranty certificate in its original form, and all the documents that came with the product. The return period is a maximum of 30 days.
  • The packages/products have severe damage.
  • The products were delivered incorrectly.
  • The products have sizes (thickness) erroneously ordered.

3.22. The steps for a return are as follows:

  1. Fill out the return form from the received package and send it to us at contact@esotericmassageacademy.com, ensuring that the product meets the return conditions mentioned above.
  2. In the form, choose one of the return options: refund of the amount paid at the time of purchase or a voucher with the value of the returned product.
  3. After the request is approved, we will send a courier to pick up the product you want to return. The product will be refunded within a maximum of 30 days from the receipt of the return, to the bank account specified in the form.

For filing a complaint/notification regarding the delivered products, the Client must address ESOTERIC MASSAGE ACADEMY in writing, at the email address contact@esotericmassageacademy.com, or through any other means that ensure the confirmation of receipt, within 3 days of receiving the products. ESOTERIC MASSAGE ACADEMY will analyze the complaint and, if justified, will remedy the situation as soon as possible.

For products that have manufacturing defects upon reception, or if the Client receives a different product than the one ordered, ESOTERIC MASSAGE ACADEMY will replace the product/products without being able to claim damages, either by refunding the value of the product within 30 days of receiving the returned product.

In the case of products that have incorrectly ordered sizes/thicknesses, ESOTERIC MASSAGE ACADEMY will replace the product. If the Client returns a product, and ESOTERIC MASSAGE ACADEMY does not have an identical product for replacement, they will offer the Client the value of the product within 30 days of receiving the returned product.

The replacement will be made under the conditions and limits of a standard order.

The cost of additional services, including but not limited to the transport of the products, paid by the Client, will not be refunded. In all cases, the return/re-shipping costs will be borne by the Client.

3.22.2. The consumer Client has the right to unilaterally terminate the distance contract, based on the right of withdrawal provided by law, without penalties and without invoking a reason, within 30 calendar days from the date of receiving the product. The only costs that may be borne by the consumer are the direct return costs of the products according to Emergency Ordinance no. 34/2014 on the rights of consumers in contracts concluded with professionals, as well as for the amendment and completion of some normative acts, for individuals purchasing products from websites using distance communication techniques, applying the definitions contained in Emergency Ordinance no. 34/2014.

According to the current legislation, a consumer is considered to be any individual or group of individuals constituted in associations, as defined in art. 2 pt. 2 of the Government Ordinance no. 21/1992 on consumer protection, republished, with subsequent modifications and completions.

3.22.3. In order to exercise the right of withdrawal, it is sufficient for the Client to send a declaration of exercising this right to our company by any means, followed by our prompt response confirming the receipt of the withdrawal request by email to the address indicated by the Client.

3.22.4. The Client will notify ESOTERIC MASSAGE ACADEMY of their intention to return the purchased products by any means of written communication (email, etc.) within a maximum of 30 working days from receiving the products, in the case of art. 7.9.1.4.

3.22.5. It is the responsibility of the Client who has notified ESOTERIC MASSAGE ACADEMY according to art. 3.22.3, 3.22.4, to ensure that the products referred to will be returned to ESOTERIC MASSAGE ACADEMY within a maximum of 30 calendar days from the date of sending the notification, otherwise, the right of withdrawal is no longer valid, considering the request invalid.

3.22.6. The ESOTERIC MASSAGE ACADEMY Client cannot return the products purchased through a Contract, and/or cannot claim any other damages/compensation if the returned product is not in the same condition in which it was delivered (in the original packaging with all the tags intact, the seal intact, and the documents that accompanied it, without any traces that may indicate that the product has been worn).

3.22.7. According to Emergency Ordinance no. 34/2014 regarding the rights of consumers in contracts concluded with professionals, as well as amending and supplementing certain normative acts, ESOTERIC MASSAGE ACADEMY reserves the right to not accept returns for products that, by their nature, cannot be returned or that can degrade or deteriorate quickly.

3.22.8 In case of refunding the value of the product, this will be done within 14 days from the date when the consumer's decision to withdraw from the contract is communicated. For orders paid with a card, the amount will be returned to the same bank account used for the transaction.

3.22.9 ESOTERIC MASSAGE ACADEMY is not obligated to refund any additional costs if the consumer has explicitly chosen a different type of delivery than the standard delivery offered by the Seller. ESOTERIC MASSAGE ACADEMY may postpone the refund until the products that have been sold are received.

3.22.10 The consumer is informed that, in case of products being returned with signs of wear, scratches, dents, mechanical or, as the case may be, electrical shocks, missing accessories, missing warranty certificates, ESOTERIC MASSAGE ACADEMY reserves the right to decide whether to accept the return or to withhold a sum from the value of the product. If the returned product is damaged or the packaging is opened, ESOTERIC MASSAGE ACADEMY reserves the right to charge an additional fee of 0-50% of the value of the products, a fee to cover the costs of bringing the products back to their original condition. This amount will be deducted from the initial payment for the products.

3.22.11 Order cancellation, including orders containing online courses, can be done within a maximum of 24 hours from the moment of payment.

4.1. The use of the website is solely the responsibility of the User.

4.2. Additionally, ESOTERIC MASSAGE ACADEMY will not be liable for any damage caused by a virus, denial-of-service or distributed denial-of-service attack, as well as any other type of technological material that could infect the User's computer, IT system and/or data as a result of accessing the website or other websites linked to this website.
